Welcome to Tudor Court Hotel Paddington!

These terms and conditions (“Terms”) set out the basis on which bookings are accepted by CDKG Limited (Company Number 07941515), trading as Tudor Court Hotel Paddington (“Hotel”, “we”, “us”, “our”). They apply to all bookings made directly with us through our website (www.tudorcourthotel.co.uk) (“Website”), by email, by telephone, in person, and, where relevant, to stays booked through third-party platforms such as Expedia, Booking.com and other online travel agents (“OTAs”), save that additional third-party terms may also apply.

By accessing our Website, making a Booking with us, or staying at the Hotel, you (“Guest”, “you” or “your”) confirm that you have read, understood and agree to be bound by these Terms. These Terms form a legally binding agreement between you and us in relation to your Booking and stay. If you do not agree to these Terms, please notify us immediately and do not proceed with using the Website or making a Booking.

We may update or amend these Terms from time to time. Any changes will be reflected by updating the “Last Updated” date at the top of these Terms. Your continued use of the Website or any booking made after the updated Terms are published shall constitute your acceptance of the revised Terms.

Please note: Capitalised words and phrases used in these Terms have the meanings given in the text where they are first introduced, or as set out in the Definitions in Section 2 below.


1. General

By using our Website, including making a Booking, you represent and warrant that:

  • you have the legal capacity and are of sufficient age to enter into a binding contract with us; and
  • you are authorised to use the debit or credit card or other payment means you provide at the time of checkout.

If you use the Website on behalf of a company or organisation, you represent and warrant that you have the necessary authority from that company or organisation to do so. Where you are acting on behalf of a company, employer, organisation, government or other legal entity (“Represented Entity”), “Guest” and “you” means the Represented Entity, and these Terms shall be legally binding on you and the Represented Entity.

If you use the Website or make a Booking on behalf of another Guest or Guests, you represent and warrant that you have the requisite authority from such other Guest(s) to do so, and that these Terms shall be legally binding on all of them.

Bookings may only be made by persons aged 18 or over. We do not accept Bookings made by or for unaccompanied persons under the age of 18. Any Guest under the age of 18 must be accompanied by a parent, legal guardian or other responsible adult aged 18 or over, who must be named on the Booking, check in with the minor and remain at the Hotel for the duration of the stay. We reserve the right to refuse check-in where any Guest appears to be under 18 and no suitable accompanying adult is present.

Where a Booking is made through an OTA or other third-party platform, any questions regarding the status of the reservation, amendment requests, cancellation requests, refunds or platform-related payment issues must be dealt with directly through that OTA or third-party platform in accordance with its terms and procedures. We shall strictly apply the terms and reservation details applicable to the Booking as made through the relevant third-party platform, in addition to these Terms to the extent applicable to the Guest’s stay.

2. Definitions

Unless otherwise defined elsewhere in these Terms, the following words and phrases have the following meanings:

Guest / youThe person or entity that enters into these Terms, including any other Guest(s) and the Represented Entity if applicable.
HotelTudor Court Hotel Paddington, located at 10–12 Norfolk Square, Tyburnia, London W2 1RS.
Intellectual Property RightsAll copyright, trade mark, design, patent, business and domain names, confidential and other proprietary rights, and any other rights to registration of such rights whether created before or after the date of this agreement, both in the United Kingdom and throughout the world.
Lead GuestThe person who makes the Booking, is named as the principal Guest on the Booking, and is responsible for the Booking, including compliance by all other Guests with these Terms.
ListingsHas the meaning given in Section 3(a).
Represented EntityHas the meaning given in Section 1.
VisitorAny person who is not named as a Guest in the relevant Booking but who attends the Hotel, enters any room or part of the Hotel premises, or otherwise accompanies, visits or seeks access to a Guest during the Guest’s stay.
Websitewww.tudorcourthotel.co.uk and any other websites the Hotel operates with the same domain name and a different extension.

3. Bookings

We advertise and make available rooms for booking on our Website and through third-party OTAs (each a “Listing”). All Listings are provided for information only and are subject to availability at the time of Booking. We reserve the right to amend or withdraw any Listing, including room availability, pricing and room details, at any time before a Booking is confirmed.

A Booking becomes binding only once it has been accepted by us and full payment has been received, or, where the Booking is made through an OTA, once the Booking has been confirmed in accordance with that OTA’s booking process.

To make a Booking through our Website, by email, by telephone, in person or through any other accepted booking channel, you must provide the information we reasonably require, which may include the Lead Guest’s full name, email address, telephone number, billing details, stay dates, Guest details, passport or other identification document, and valid debit or credit card information for payment and verification purposes.

You confirm and warrant that all information provided to us in connection with a Booking is true, accurate, complete, current and not misleading, and that you are authorised to use any payment card or payment method provided. Where a Booking is made on behalf of more than one Guest, the person making the Booking confirms that they are authorised to provide the personal details of all Guests included in the Booking and to accept these Terms on their behalf.

Once the Booking process is complete and payment has been successfully received, you will receive a booking confirmation email setting out the details of your stay. No Booking shall be treated as confirmed until such confirmation has been issued by us. All Bookings remain subject to check-in verification.

4. Information and Pre-Authorisation

On arrival, the Lead Guest and, where requested, any other Guest must present:

  • valid original photographic identification in a form acceptable to the Hotel, such as a passport, photocard driving licence or other government-issued photographic ID; and
  • the physical debit or credit card used to make the Booking for verification purposes. In the case of pre-authorisation, the Lead Guest must present the same card or another physical card in the Lead Guest’s own name that is acceptable to us upon arrival. Failure to do so may result in refusal of check-in or cancellation of the Booking.

We reserve the right to inspect, take copies of and retain such identification documents where reasonably necessary for the purposes of identity verification, security, fraud prevention, safeguarding, incident investigation, prevention or detection of anti-social behaviour or criminal activity, and the protection of our guests, staff, premises, property and services.

If the named Lead Guest is unable to present the required physical card on arrival, we may, at our sole discretion, accept a cash damage deposit of £100 as an alternative. Any such cash deposit will be held until check-out and returned only once the room has been inspected and confirmed to be in satisfactory condition and no charges remain outstanding.

The Hotel reserves the right, following inspection of the room at the time of departure, to apply the pre-authorised amount and/or retain or deduct from the deposit such sums as are reasonably required to cover any damage, loss, missing items, additional cleaning, or other outstanding charges attributable to the Guest’s stay.

If neither the required physical card nor the £100 cash damage deposit is provided at check-in, we reserve the right to decline the reservation, refuse entry and/or treat the Guest as having failed to comply with these Terms.

We reserve the right to refuse check-in, cancel a Booking or require a guest to leave where we have reasonable grounds to believe that any information provided is incomplete, inaccurate, misleading, fraudulent or unauthorised, or where we are unable to complete satisfactory identity, age, card or security verification. Please refer to our Privacy Policy for further information on how we handle your personal data.

We reserve the right to require a further or increased pre-authorisation during your stay where the duration is extended, additional nights are added, or we reasonably consider that the existing pre-authorisation or deposit is no longer sufficient. Failure to provide any such further amount may result in refusal of the extension or termination of the stay.

5. Proxy Bookings

The person named on the booking (“Lead Guest”) must be staying at the Hotel for the duration of the booking or, at minimum, must be one of the staying Guests. Bookings must not be made on behalf of another person where the named booker will not be staying, unless we have expressly agreed otherwise in writing before arrival.

We may require the Lead Guest to be present at check-in and, where necessary, at any point during the stay for verification purposes. Where we reasonably believe a booking has been made on behalf of a person not entitled to stay under these Terms, or the named booker is not present and staying, we may refuse check-in, cancel the Booking and require the occupants to leave.

6. Check-In, Arrival and No-Show

Check-in is generally available from 3:00 PM on the scheduled date of arrival. Early check-in may be permitted strictly subject to availability and shall be at our sole discretion. Where early check-in is approved, an additional charge of £20 shall apply, save that this charge may be waived for direct bookings made with the Hotel. We do not guarantee that any room will be available before the stated check-in time unless expressly agreed by us in writing.

Check-out is generally by 10:00 AM on the scheduled date of departure. For direct bookings made with the Hotel, check-out is by 11:00 AM. If a Guest fails to vacate the room by that time, we reserve the right to charge additional sums, including for late check-out, extended occupation, any resulting loss of business, and any costs reasonably incurred by us as a result.

We may, at our discretion, agree to store Guests’ luggage before check-in or after check-out. Any such storage is offered as a courtesy only, strictly subject to space, staffing and operational requirements. Luggage is left entirely at the Guest’s own risk and, to the fullest extent permitted by law, we accept no responsibility for any loss of or damage to any luggage or personal belongings left with us, unless caused by our negligence or other liability which cannot lawfully be excluded.

Guests are expected to arrive and check in on the scheduled arrival date. If the Guest has not arrived by 12:00 midnight on the scheduled check-in date, the Booking shall be treated as a no-show and may be cancelled by us, unless before midnight we have received an email directly from the Lead Guest named on the Booking notifying us of the late arrival and we have agreed to hold the Booking.

Notification of late arrival must be sent by the Lead Guest directly. Notification from a third party — including a friend, relative, driver, agent or any other person — shall not be sufficient unless expressly accepted by us in writing.

In the event of a no-show, the full booking value will be charged or retained by us and the Guest shall have no right to any refund, credit or transfer, subject always to any mandatory rights the Guest may have under applicable law. If a Guest arrives after the Booking has been treated as a no-show and cancelled, we shall have no obligation to reinstate the Booking or provide accommodation, although we may do so at our sole discretion and subject to availability.

7. Payment

All room rates, charges and other prices displayed on our Website (together, the “Booking Amount”) are stated in Pounds Sterling (GBP/£) unless expressly stated otherwise. All rates are subject to change at any time prior to confirmation of a Booking. The price applicable to your Booking will be the price communicated to you at the time you complete the Booking process.

All online Bookings must be paid for in full at the time of Booking, unless we expressly agree otherwise in writing. A Booking shall not be treated as confirmed unless and until:

  • the Booking process has been completed;
  • the required payment has been successfully authorised and received by us or on our behalf; and
  • a Booking confirmation has been issued by us or, in the case of a Booking made through an OTA, the Booking has been confirmed in accordance with that OTA’s booking process.

We reserve the right to refuse, cancel or suspend any Booking where payment is declined, reversed, recalled or charged back; the payment card cannot be verified; we reasonably suspect the transaction is fraudulent or unauthorised; or payment has otherwise not been successfully received in full and in cleared funds.

We may use third-party payment service providers and payment gateways to process online payments (“Payment Providers”). The processing of payments by the Payment Providers is subject to their own terms and conditions and privacy policies. To the fullest extent permitted by law, we shall not be responsible for the security, availability, performance or operation of any Payment Provider, nor for any error, delay, breach, outage or failure attributable to any Payment Provider.

By submitting payment details, you confirm that you are authorised to use the relevant payment method; the payment details provided are valid, accurate and complete; and you authorise us and/or our Payment Providers to take payment for the Booking Amount and any other charges properly due under these Terms.

If, after a Booking has been made, we discover that the price displayed was incorrect due to a manifest error, technical issue or administrative mistake, we will contact you as soon as practicable and provide you with the option to reconfirm the Booking at the correct price, or to cancel the Booking. If you elect to cancel and payment has already been taken, we will refund the amount paid to the original payment method.

Unless expressly stated otherwise in these Terms or required by applicable law, all payments made are non-refundable. We reserve the right to set off, deduct or recover from any sums paid, or from any pre-authorised card amount, any charges properly due to us under these Terms.

8. Guest Conduct and Behaviours

The Hotel, guest rooms and all Hotel facilities must be used only for lawful purposes and in accordance with these Terms. Guests must not use the Hotel for any unlawful, improper, unsafe or anti-social purpose. Only the Guests named on the Booking may occupy the room or stay at the Hotel, unless we expressly agree otherwise in writing. The Lead Guest remains responsible for the conduct, acts and omissions of all persons included in the Booking and any Visitor or invitee admitted to the Hotel by that Guest.

Guests must at all times:

  • behave in a respectful, safe and lawful manner;
  • comply with these Terms and any reasonable instructions given by Hotel staff;
  • refrain from any conduct which may disturb, inconvenience, endanger, harass or cause nuisance to other Guests, staff, neighbours or Visitors; and
  • use the room and Hotel premises only for their proper purpose and in a manner consistent with ordinary hotel use.

We operate a zero-tolerance policy in relation to abusive, threatening, violent, intimidating, obscene, discriminatory or otherwise unacceptable behaviour towards our staff, contractors, Guests or any other person on the Hotel premises.

We reserve the right to refuse check-in, refuse entry, cancel a Booking, require a Guest or Visitor to leave the Hotel, or involve the police or other relevant authorities where, in our reasonable opinion, the Guest or Visitor is acting in breach of these Terms; behaving in an unlawful, abusive, threatening, aggressive, disruptive or unsafe manner; or where the safety, security, comfort or wellbeing of staff, Guests, Visitors or the Hotel is, or is likely to be, adversely affected.

We further reserve the right to refuse check-in, refuse entry, cancel a Booking or require any Guest or Visitor to leave where, in our reasonable opinion, that person is intoxicated or appears to be under the influence of alcohol, illegal drugs, psychoactive substances or any other substance to such an extent that their condition may pose a risk to themselves, to others, or to property, or may cause disorder, nuisance or disruption.

No refund, compensation, credit or alternative accommodation shall be due where we exercise our rights under this section as a result of the Guest’s conduct, condition, breach of these Terms, or failure to comply with our reasonable requirements.

Guests must not permit unauthorised Visitors into guest rooms or other restricted areas of the Hotel without our prior consent. Guests are responsible for keeping the room, fixtures, fittings, furnishings and all other Hotel property in a reasonable condition throughout the stay. Guests shall be liable for any loss, damage, breakage, missing items, excessive soiling, specialist cleaning, or other cost or expense incurred by us arising from the acts or omissions of the Guest or any person for whom the Guest is responsible.

Smoking or vaping is prohibited except in any designated area expressly identified by us for that purpose. Where a Guest smokes or vapes in a prohibited area, tampers with smoke detectors or other fire safety equipment, or causes the room or Hotel premises to require additional cleaning, deodorising, repair or service interruption, we reserve the right to charge the Guest for all associated losses, costs and expenses, including any loss of revenue resulting from the room being withdrawn from use.

9. Information on the Website

While we make every effort to ensure that the information on the Website is as up-to-date and accurate as possible, you acknowledge and agree that, to the maximum extent permitted by law, we do not guarantee that:

  • the Website will be free from errors or defects;
  • the Website will be accessible at all times;
  • messages sent through the Website will be delivered promptly, or delivered at all;
  • information you receive or supply through the Website will be secure or confidential; or
  • any information provided through the Website is accurate or true.

We reserve the right to change any information or functionality on the Website at any time without notice, including product descriptions, prices and other Website content.

11. Facilities at the Hotel

Wi-Fi

We offer complimentary standard Wi-Fi for general browsing and ordinary use, subject to availability, network coverage, fair use and technical limitations. Premium Wi-Fi may be available on request for an additional charge. We do not warrant that Wi-Fi will be uninterrupted, secure, error-free or suitable for streaming, business-critical use, video conferencing, gaming or any particular purpose. Guests must not use the Hotel’s internet services for any unlawful, abusive, offensive, infringing or inappropriate purpose.

Meals

The Hotel does not provide breakfast, lunch, dinner or any other meals unless expressly stated otherwise in writing. Any references on third-party platforms, historic listings or informal communications suggesting meal availability shall not form part of the booking contract unless expressly confirmed by us in writing.

Equipment

We may provide Guests, on request and subject to availability, with certain equipment, accessories or devices for use during their stay, including, for example, air-conditioning remote controls. All such items remain the property of the Hotel and must be returned in accordance with these Terms. If any such item is not returned on check-out, we reserve the right to charge the Guest the full replacement cost of the item together with an administration fee equal to 25% of that replacement cost.

12. Intellectual Property

We retain ownership of, and reserve all rights in, any Intellectual Property Rights owned or licenced by us for all materials developed and/or provided in connection with the Website, including text, graphics, logos, design, icons, images, sound and video recordings, pricing, downloads and software (“Website Content”).

You may make a temporary electronic copy of all or part of the Website Content for the sole purpose of viewing and using the Website. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the Website Content.

13. Links to Other Websites

Our Website may integrate or provide links to third-party websites, applications, software and services that are not owned, controlled, or operated by us, including third-party payment processors and booking providers (“Third-Party Providers”). We are not responsible for the content, functionality, security, performance, or policies of any Third-Party Provider.

Your use of any Third-Party Provider is subject to their own terms and conditions and privacy policies, and we strongly advise you to review and understand those terms before using their services or providing any personal information. The inclusion of a link or integration with any Third-Party Provider on our Website does not constitute our endorsement, approval, or recommendation of that provider or their services.

We do not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with your use of the Website. 15. Cancellations

Any cancellation of a Booking shall be governed by these Terms together with our separate Cancellation Policy, which is available on our Website. The Cancellation Policy forms part of the contractual arrangements between you and us. Where cancellation is referred to in these Terms, you should also refer to the Cancellation Policy for further detail.

16. Complaints

Any complaint relating to a Booking or stay at the Hotel should be submitted to us in writing by email in accordance with our Complaints Procedure, as published on our Website. Guests are encouraged to raise any issue as soon as reasonably practicable, so that we have a reasonable opportunity to investigate the matter and, where appropriate, seek to resolve it.

17. Liability

Personal Belongings

You are responsible for your own money, valuables, documents, devices, luggage and all other personal belongings brought to or left at the Hotel. Any such items are brought onto, stored at or left at the Hotel entirely at your own risk.

Lost property will be retained for a maximum of 14 days following check-out. Guests must claim any lost items within this period, after which unclaimed items may be disposed of. Items may be collected in person or returned by postage or courier, with all shipping or courier costs borne by the Guest. We will charge a £25 administration fee for arranging and coordinating returns.

We shall not be liable for any loss of or damage to any money, valuables, luggage or other personal belongings, except to the extent that such loss or damage is caused by our negligence or other breach of duty for which liability cannot lawfully be excluded or restricted.

Limitation of Liability

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of your statutory rights as a consumer, or any other liability which cannot lawfully be excluded or limited under applicable law.

Subject to the above, we exclude, to the fullest extent permitted by law, all conditions, warranties, representations and other terms which might otherwise be implied by statute, common law or equity into these Terms. Our total aggregate liability to you arising out of or in connection with these Terms shall be limited to an amount equal to the Booking Amount paid or payable by you for the stay giving rise to the claim.

We shall not be liable for any special, indirect, incidental or consequential loss or damage; loss of enjoyment, loss of opportunity, loss of reputation or disappointment; any loss of profits, revenue, business, contracts, anticipated savings, goodwill, data, or opportunity; or loss arising from events outside our reasonable control, including transport disruption, utility failure, acts of God, public health events, industrial disputes, government action or failure of third-party systems or providers.

Warranties

We shall use reasonable care and skill in providing accommodation and related services at the Hotel. Subject to any rights which you may have under applicable law, we provide the Hotel, accommodation, Website and any related facilities and services on an “as available” basis and do not make any representation, warranty or guarantee that the Hotel or Website will always be available, uninterrupted or fault-free; that any service, amenity or facility will be suitable for your individual preferences or requirements; or that your stay will be free from matters outside our reasonable control.

Indemnity

You shall be responsible for, and shall on demand reimburse us in respect of, any loss, damage, liability, cost, charge, expense or claim (including reasonable legal and professional costs) suffered or incurred by us arising out of or in connection with:

  • any breach by you, or by any Guest, Visitor or other person for whom you are responsible, of these Terms;
  • any inaccurate, misleading, false or incomplete information provided by you in connection with a Booking or check-in;
  • any misuse of our Website, booking system, room, facilities or Hotel premises;
  • any negligent, reckless, abusive, unlawful or otherwise inappropriate act or omission by you or by any person for whom you are responsible;
  • any damage to the Hotel, any room, fixtures, fittings, furnishings or other property caused by you or by any person for whom you are responsible;
  • any smoking or vaping breach, tampering with fire or safety equipment, or any act requiring additional cleaning, repair, replacement or reinstatement; or
  • any claim brought by a third party arising from or connected with your Booking, your stay, or the acts or omissions of you or any person for whom you are responsible.

The Lead Guest shall be treated as responsible not only for their own acts and omissions, but also for the acts and omissions of all Guests included in the Booking and any Visitor admitted to the Hotel by or through them. Nothing in this section shall require you to indemnify us for any loss to the extent that it arises directly from our own negligence, fraud or wilful default.

18. Force Majeure

If the Hotel becomes unable, wholly or in part, to carry out an obligation under these Terms (other than an obligation to pay money) due to a Force Majeure Event, the Hotel shall give you prompt written notice of reasonable details of the Force Majeure Event and, so far as is known, the probable extent to which the Hotel will be unable to perform or will be delayed in performing its obligation. The relevant obligation will be suspended during the Force Majeure Event to the extent it is affected. The Hotel shall use its reasonable endeavours to overcome or remove the Force Majeure Event as quickly as possible.

For the purposes of these Terms, a “Force Majeure Event” means any of the following, to the extent outside the Hotel’s reasonable control:

  • act of God, lightning strike, earthquake, storm, flood, landslide, explosion or fire;
  • strikes or other industrial action outside of the control of the Hotel;
  • war, terrorism, sabotage, blockade, revolution, riot, insurrection, civil commotion, epidemic or pandemic;
  • any decision of a government authority in relation to a public health emergency, government orders or any threat thereof, to the extent it affects the Hotel’s ability to perform its obligations; or
  • any shortage or interruption in the supply of cleaning products, power, oil, gas, water or other utilities, or any failure of plant, machinery, essential systems or services.

19. General Provisions

Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. Each party irrevocably submits to the exclusive jurisdiction of the courts of England and courts of appeal from them in respect of any proceedings arising out of or in connection with these Terms.

Waiver

No party to these Terms may rely on the words or conduct of any other party as a waiver of any right unless the waiver is in writing and signed by the party granting the waiver.

Severance

Any term of these Terms which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity and enforceability of the remainder of these Terms is not affected.

Joint and Several Liability

An obligation or a liability assumed by, or a right conferred on, two or more persons binds or benefits them jointly and severally.

Assignment

A party shall not assign, novate or otherwise transfer any of its rights or obligations under these Terms without the prior written consent of the other party.

Entire Agreement

These Terms embody the entire agreement between the parties and supersede any prior negotiation, conduct, arrangement, understanding or agreement, express or implied, in relation to the subject matter of this agreement.

Third Party Rights

This agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

Interpretation

In these Terms: words in the singular include the plural (and vice versa); a reference to £ or GBP is to the currency of the United Kingdom; words importing a gender include all genders; a reference to “person” includes an individual, corporation, authority, partnership, trust and any other entity; headings are for convenience only and do not affect interpretation; the word “includes” is not a word of limitation; and “in writing” or “written” includes communication by email.
